These Terms of Use ("Terms") govern your access to and use of the website at bost.sa, the Mijhar diagnostic and the Bayyina reading it produces, the BOST engine platform, and any related services (together, the "Services") operated by Business of Smart Things ("BOST", "we", "us"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Who we are
BOST is a Saudi operational-AI and delivery firm. Our registered particulars, including our commercial registration and registered address, are available on request from the contact point in Section 12. References to the Kingdom mean the Kingdom of Saudi Arabia.
2. The Services
The Services include public content, the Mijhar diagnostic (an AI-assisted intake that produces a Bayyina reading), and access-controlled areas of the BOST engine platform for clients and consultants. We may add, change, suspend, or withdraw any part of the Services at any time.
3. Nature of AI output, estimates, and readings
The Mijhar diagnostic, the Bayyina reading, roadmaps, scopes, timeframes, cost or value figures, and any other output produced by or through the Services are generated with the assistance of artificial intelligence and are provided for general information and discussion only. They are:
- Indicative estimates, not commitments. Any timeframe, phase duration, scope, or figure is an early, indicative estimate. It is not a quotation, a fixed price, a service-level guarantee, or a promise of any particular outcome, and it will be refined with you in a working session before any engagement.
- Not professional advice. Output does not constitute legal, financial, investment, tax, engineering, or other professional advice, and must not be relied upon as such.
- Not a binding offer. No engagement, retainer, or contractual relationship is created by using the Services. A relationship arises only under a separate written agreement signed by an authorised representative of BOST.
AI output may contain errors or omissions. You are responsible for evaluating its suitability for your purposes.
4. Accounts and access
Some areas of the Services require an account. You are responsible for the accuracy of your registration details, for keeping your credentials confidential, and for all activity under your account. Notify us promptly of any unauthorised use. We may suspend or terminate access where these Terms are breached or where we reasonably suspect misuse.
5. Acceptable use
You agree not to misuse the Services, including by: attempting to gain unauthorised access; interfering with or disrupting the Services; probing, scanning, or testing security without our written consent; scraping or extracting data at scale; uploading unlawful, infringing, or harmful content; or using the Services in breach of any applicable law of the Kingdom or any other jurisdiction that applies to you.
6. Your content and submissions
You retain ownership of the information you submit through the Services, including your answers in the Mijhar diagnostic. You grant BOST a limited licence to process that information to operate and improve the Services and to prepare your reading, in accordance with our Privacy Policy. You confirm you have the right to share any information you submit and that doing so does not breach any confidentiality or data-protection obligation you owe to others.
7. Intellectual property
The Services, including their content, design, software, and the Mijhar and Bayyina methods and marks, are owned by BOST or its licensors and are protected by applicable intellectual-property laws. Except as expressly permitted, you may not copy, reproduce, modify, distribute, or create derivative works from the Services without our prior written consent. The Bayyina reading is provided to you for your internal evaluation.
8. Third-party services
The Services rely on third-party providers, including AI model providers and communication tools, to function. Your use may be subject to those providers' terms. We are not responsible for third-party services we do not control.
9. Disclaimers
The Services are provided "as is" and "as available" to the fullest extent permitted by applicable law. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any output will be accurate or fit for a particular purpose.
10. Limitation of liability
To the maximum extent permitted by the laws of the Kingdom, BOST shall not be liable for any indirect, incidental, special, consequential, or punitive loss, or for any loss of profit, revenue, data, or goodwill, arising out of or in connection with your use of, or inability to use, the Services or any output. Nothing in these Terms excludes liability that cannot lawfully be excluded.
11. Governing law and dispute resolution
These Terms, and any dispute or claim arising out of or in connection with them or the Services, are governed by the laws and regulations of the Kingdom of Saudi Arabia. The competent courts of the Kingdom shall have jurisdiction, without prejudice to any mandatory consumer or data-protection rights available to you under Saudi law, including the Personal Data Protection Law.
12. Changes and contact
We may update these Terms from time to time. Material changes take effect when the updated Terms are posted, with the "last updated" date revised above. Continued use after an update means you accept the revised Terms.
